Partner Visas are for Spouse or De Facto Partner of Australian citizens and permanent residents
This stream enables the spouse or de facto partner and their children (if applicable) of Australian citizens and permanent residents to stay in Australia and to provide them with pathways to citizenship. Partner visas predominantly made up the Family Visa Stream. Family Migration is an important element of Australia’s migration system, as it not only serves family reunification, but it also results in a stronger social cohesion, with family members making valuable social contributions to their families and local communities.

Eligibility
Each visa subclass has its eligibility criteria. Depending on your circumstances, we can guide you with what you will need, to put forward the best Application possible.
Primary Requirements
Each visa subclass has its own requirements, which we will guide you through and assist you with, but the most common primary requirements are below:
- be at a right age
- be in a genuine and continuing relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet relationship requirements
- must have a sponsor who is your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet character and health requirements
- depending on the visa subclass must be inside or outside Australia (as well as the family members who are included in the application) when you lodge your application.
- be in or outside Australia when your temporary visa application is decided
- must be for the best interests of the child (if applicable)

Partner (Provisional) visa (subclass 309)
This visa is for a spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen, who is currently living offshore.
This is a temporary visa, which leads to a permanent visa Partner (Migrant) visa (subclass 100).
You must meet the basic requirements.
Eligibility:
- be at a right age
- be in a genuine and continuing relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet relationship requirements
- must have a sponsor who is your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet character and health requirements
- must be outside Australia (as well as the family members who are included in the application) when you lodge your application.
- be in or outside Australia when your visa application is decided
- must be for the best interests of the child (if applicable)
This visa enables you to:
- live, study and work in Australia while your permanent Partner visa is being processed
- enrol in Medicare
- travel in and out of Australia as many times as you desire
- attend free English classes

Partner (Migrant) visa (subclass 100)
This visa is for a spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen.
This is a permanent visa and granted to Partner (Provisional) visa (subclass 309) holders.
You must meet the basic requirements.
Eligibility:
- continue to be in a genuine and ongoing relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- continue to meet relationship requirements
- must have a sponsor who is your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet character and health requirements
- must be for the best interests of the child (if applicable)
- must hold a temporary Partner visa (subclass 309)
This visa enables you to:
- live, study and work in Australia indefinitely
- enrol in Medicare
- travel in and out of Australia for 5 years
- attend free English classes
- sponsor eligible family members
- once eligible, apply to become an Australian citizen

Partner visa (Temporary) (subclass 820)
This visa is for a spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen, who is in Australia at the time of application.
This is a temporary visa, which leads to a permanent visa Partner visa (Permanent) (subclass 801).
You must meet the basic requirements.
Eligibility:
- be at a right age
- be in a genuine and continuing relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet relationship requirements
- must have a sponsor who is your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet character and health requirements
- must be in Australia and hold a substantive visa (as well as the family members who are included in the application) when you lodge your application.
- be in or outside Australia when your visa application is decided
- must be for the best interests of the child (if applicable)
This visa enables you to:
- live, study and work in Australia while your permanent Partner visa is being processed
- enrol in Medicare
- travel in and out of Australia as many times as you desire
- attend free English classes

Partner visa (Permanent) (subclass 801)
This visa is for a spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen.
This is a permanent visa and granted to Partner visa (Temporary) (subclass 820) holders.
You must meet the basic requirements.
Eligibility:
- continue to be in a genuine and ongoing relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen, who sponsored you for the temporary Partner visa
- continue to meet relationship requirements
- must have a sponsor who is your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet character and health requirements
- must be for the best interests of the child (if applicable)
- must hold a Partner visa (Temporary) (subclass 820)
This visa enables you to:
- live in Australia on a permanent basis
- work in Australia and study at Australian educations institutions
- enrol in Medicare
- travel in and out of Australia for 5 years
- attend free English classes
- sponsor eligible family members
- once eligible, apply to become an Australian citizen

Prospective Marriage visa (subclass 300)
This visa is for applicants to come to Australia to marry their prospective spouse then continue with a Partner visa application.
This is a temporary visa.
You must meet the basic requirements.
Eligibility:
- be 18 years of age or older
- must have a sponsor who is an Australian citizen, permanent resident or eligible New Zealand citizen
- meet relationship requirements
- intend to marry your prospective spouse before the visa period expires
- meet character and health requirements
- must be outside Australia (as well as the family members who are included in the application) when you lodge your application.
- be outside Australia when your visa application is decided
- must be for the best interests of the child (if applicable)
This visa enables you to:
- stay in Australia for 9 to 15 months from the visa grant date
- work and study in Australia
- travel in and out of Australia as many times as you desire while the visa is valid
- apply for a Partner visa (subclass 820 and 801) after you are married and before your Prospective Marriage visa expires
